Changes, Travel & Departures

Plan Before Employment or Travel Changes

University-sponsored immigration status is connected to specific employment information reviewed during the immigration process. Changes to a faculty member’s position, duties, salary, work schedule, worksite, department, or employment dates may require immigration review before they take effect.

This page explains when faculty members and departments should contact International Student and Scholar Services (ISSS), considerations for international travel, and the steps to take when CSUSB employment will end.

Notify ISSS Before an Employment Change

Departments should notify ISSS before implementing a change that may affect a faculty member’s university-sponsored immigration status or employment authorization.

Faculty members may also contact ISSS when they become aware of a proposed change. Notification through a regular university personnel process does not necessarily mean that ISSS has received or reviewed the change.

Early notification allows ISSS to determine whether updated employer documentation, a new Labor Condition Application, an amended petition, or another immigration action may be required.

Contact ISSS Before These Changes Occur

Departments and faculty members should contact ISSS before making or accepting changes involving:

Position and Appointment Changes
  • Job title or academic appointment;
  • Primary duties or teaching responsibilities;
  • Salary or other compensation;
  • Full-time equivalency or scheduled hours;
  • Department, college, or reporting unit;
  • Appointment or contract dates;
  • Funding source when it affects the position; or
  • Additional or concurrent employment.

Location and Work Arrangement Changes
  • Primary campus or worksite;
  • Assignment to another CSUSB location;
  • Regular remote work;
  • A new hybrid-work arrangement;
  • Working from another state;
  • An extended period of work outside California; or
  • Performing university work while outside the United States.

Not every change requires a new immigration filing. ISSS must review the circumstances before the university determines whether immigration action is needed.

Before International Travel

Faculty members do not need to report routine international travel to ISSS or obtain ISSS approval before traveling.

International travel can nevertheless affect a visa application, pending immigration filing, or the documents needed to return to the United States. Faculty members should review their immigration documents before departure and contact ISSS or qualified immigration counsel when case-specific questions arise.

Review Your Documents Before Departure

Before traveling, review:

  • Passport validity;
  • Whether a valid visa in the appropriate classification will be required for return;
  • Form I-797 approval notice, when applicable;
  • Employment-verification or employer-support documentation that may be needed;
  • Documents for any accompanying dependents;
  • The expiration dates on the current petition and Form I-94; and
  • Any pending immigration petition or application that travel could affect.

Requirements vary according to immigration classification, destination, visa availability, and individual circumstances. An approved petition does not guarantee visa issuance or admission to the United States.

Keep Your Department Informed

Faculty members should inform their department chair or dean of planned international travel, particularly when travel occurs near an instructional period.

Visa processing, administrative processing, or admission issues can delay a faculty member’s return. Advance notice helps the academic unit prepare if changes to course instruction, coverage, or scheduling become necessary.

Contact ISSS or Your Attorney Before Traveling

Seek case-specific guidance before leaving the United States if:

  • A petition requesting a change or extension of status is pending;
  • An amended or change-of-employer petition is pending;
  • Form I-485 or another permanent-residency application is pending;
  • You plan to travel using advance parole;
  • Your visa has expired and you will apply for a new visa abroad;
  • Your anticipated return date is near or after the expiration of your petition or Form I-94; or
  • Your employment has changed since your current visa or petition was issued.

Travel can affect different applications in different ways. Faculty members should not assume that the same travel rules apply to every immigration classification or pending filing.

U.S. Department of State: Visa Wait TimesCBP: Retrieve Your Form I-94

After returning to the United States, faculty members should retrieve and review their new Form I-94. Contact ISSS promptly if the classification or admission expiration date appears incorrect.

Leave and Changes in Work Schedule

A leave of absence, reduction in scheduled work, or other interruption of employment may affect university-sponsored immigration status and employer wage obligations.

Departments and faculty members should contact ISSS before a leave or reduced appointment begins. Approval through a university personnel or leave process does not necessarily confirm that the change is permissible under the faculty member’s immigration classification.

Examples Requiring Advance Review

Contact ISSS regarding:

  • Paid or unpaid leave;
  • A reduction in full-time equivalency or scheduled hours;
  • Medical, parental, or other extended leave;
  • A temporary interruption in teaching or other assigned duties;
  • Furlough or other employer-directed nonproductive time; or
  • A change affecting salary, benefits, or appointment dates.

ISSS will coordinate with the department, Faculty Affairs and Development, Human Resources, and other university offices as appropriate.

Notify ISSS Before CSUSB Employment Ends

The department should notify ISSS as early as possible when a faculty member’s employment will end. The notice should include the anticipated final working date and whether the departure is voluntary or initiated by the university.

Faculty members may also notify ISSS directly. OFAD or Human Resources should coordinate with ISSS when the employment action may affect university-sponsored immigration status or create employer notification responsibilities.

Leaving CSUSB Voluntarily

Faculty members should contact ISSS before:

  • Resigning from CSUSB;
  • Accepting employment with another employer;
  • Transferring to another institution;
  • Ending employment before the petition expiration date; or
  • Relying on a pending petition filed by another employer.

Authorization to work for another employer depends on the immigration classification and individual circumstances. A faculty member should not begin new employment until the appropriate authorization requirements have been satisfied.

University-Initiated End of Employment

Departments, OFAD, or Human Resources should involve ISSS before an employer-initiated termination whenever possible.

ISSS will help coordinate required immigration notifications and determine whether the university may have responsibilities related to petition withdrawal, employer documentation, or return transportation.

Immigration Status May Be Affected Immediately

University-sponsored work authorization is connected to the approved CSUSB employment. When that employment ends, the individual may no longer work for CSUSB unless another form of employment authorization applies.

Some individuals in H-1B, E-3, O-1, or TN status may be eligible for a discretionary grace period of up to 60 consecutive days or until the end of the authorized validity period, whichever is shorter. The grace period is not guaranteed and does not itself provide authorization to work.

Faculty members should consult qualified immigration counsel promptly regarding possible next steps, deadlines, travel, dependent status, or employment with another organization.

Planning a Change or Departure?

Contact ISSS before a change to university employment occurs or as soon as an anticipated final employment date becomes known.

Departments should provide the faculty member’s name, current position, proposed change, and intended effective date.
