Employment Changes & Endings

Plan Before Employment Changes or Endings

University-sponsored immigration status is connected to specific employment information reviewed during the immigration process. Changes to an employee’s position, duties, salary, work schedule, worksite, department, appointment dates, or other employment terms may require immigration review before they take effect.

CSUSB departments should contact International Student and Scholar Services (ISSS) before making a change to employment covered by university-sponsored immigration status or when sponsored employment will end.

Early notice gives ISSS time to review the proposed action and determine whether updated documentation or another immigration step is required.

Contact ISSS Before Making a Change

Departments should contact ISSS before implementing a change that may affect an employee’s university-sponsored immigration status or employment authorization.

Approval through a department, college, Human Resources, Faculty Affairs and Development, or another university process does not necessarily mean that ISSS has reviewed the immigration impact of the change.

ISSS will review the proposed change and determine whether updated employer documentation, an amended or new immigration filing, or another action is required.

When immigration review is required, wait for ISSS guidance before implementing the change.

Changes That Require ISSS Review

Contact ISSS before implementing changes to employment information that was reviewed as part of a university-sponsored immigration process.

Position and Employment Terms

Contact ISSS before changing:

  • Job title or position;
  • Significant job duties or responsibilities;
  • Salary or other compensation;
  • Full-time or part-time status;
  • Scheduled hours or work arrangement;
  • Department, college, or reporting unit;
  • Appointment start or end dates; or
  • An additional CSUSB appointment or concurrent employment arrangement.
Work Location and Remote Work

Contact ISSS before changing:

  • The employee’s primary worksite;
  • The CSUSB location where the employee regularly works;
  • A remote or hybrid work arrangement;
  • Regular work from a location that was not previously reviewed; or
  • Other changes to where the sponsored employment will be performed.

ISSS will determine whether the proposed change affects the employee’s immigration documentation or requires additional action before the new arrangement begins.

Leave, Work Schedule, and Additional Appointments

Some employment changes may affect the terms of university-sponsored immigration status even when the employee remains in the same position.

Contact ISSS before implementing a change involving leave, work schedule, workload, or an additional appointment.

Changes in Leave, Schedule, or Additional Employment

Examples include:

  • A proposed leave of absence or other interruption in active employment;
  • A reduction or increase in scheduled hours or full-time equivalency;
  • A temporary or ongoing change in work schedule;
  • An additional CSUSB appointment;
  • Concurrent employment or duties outside the position previously reviewed; or
  • Another employment arrangement that changes the terms originally reviewed by ISSS.

ISSS will review the circumstances and determine whether the proposed arrangement is consistent with the employee’s current immigration status or requires additional documentation or action.

When Sponsored Employment Will End

Departments should notify ISSS promptly when university-sponsored employment will end earlier than expected or when an employee will no longer continue in the position connected to the immigration sponsorship.

The appropriate immigration follow-up may depend on how and when the employment ends.

Contact ISSS when:

  • An employee resigns;
  • An employee will leave CSUSB before the expected appointment end date;
  • An employee will not begin the approved appointment;
  • A department will not renew or continue an appointment;
  • A position is eliminated or employment is otherwise ended by the university; or
  • Another action will result in the employee no longer performing the sponsored employment.

Early notification allows ISSS to review the immigration record and identify any required university follow-up.

Contact ISSS Before Finalizing an Employer-Initiated Ending

When CSUSB plans to end university-sponsored employment before the expected end of the approved employment period, contact ISSS before the action is finalized whenever possible.

Employer-initiated endings may create immigration-related employer responsibilities or require follow-up with government agencies. ISSS will review the case and coordinate the appropriate immigration steps with the department and other university offices.

Completion of a department, college, Human Resources, or Faculty Affairs and Development process does not by itself complete the university’s immigration responsibilities.

Do not provide the employee with immigration guidance about the effect of the employment ending unless that guidance has been confirmed by ISSS.

Employee Resignation or Early Departure

Departments should notify ISSS promptly when a university-sponsored employee resigns, departs earlier than expected, or otherwise stops working in the sponsored position.

The employee may also contact ISSS directly, but department notification is still important because ISSS may need to review the university’s immigration records and determine whether any employer follow-up is required.

When contacting ISSS, provide the employee’s anticipated or actual final employment date and any other relevant information about the ending of the appointment.

ISSS will advise the department and employee about the appropriate immigration-related next steps.

What Happens After the Department Contacts ISSS

After a department reports a proposed employment change or ending:

  1. ISSS reviews the proposed action and current immigration sponsorship.
    The review may include the employee’s current immigration classification, approved employment information, immigration documents, and the proposed change.
  2. ISSS determines whether immigration action is required.
    Depending on the circumstances, ISSS may determine that updated university documentation, an amended or new filing, government notification, or another step is necessary.
  3. ISSS requests any additional information or documents needed for the review.
    The department, employee, Human Resources, Faculty Affairs and Development, or another university office may be asked to provide supporting information.
  4. ISSS provides the applicable next steps.
    ISSS will explain what immigration-related action is required and coordinate with the appropriate university offices when necessary.
  5. The department implements the change at the appropriate time.
    When immigration action must occur before the employment change takes effect, wait for ISSS confirmation before implementing the new arrangement.

Contact ISSS About an Employment Change or Ending

Contact ISSS as early as possible when a change is being considered or when university-sponsored employment may end.

Include enough information for ISSS to understand the proposed action, such as the type of change, anticipated effective date, and the employee’s current position or appointment.

ISSS will review the circumstances and advise the department about the appropriate immigration-related next steps.
