Employees named as an individual defendant have the right to be represented and hire your own legal counsel at your expense. The University will, however, offer to provide you with a defense if the lawsuit claimant alleges that you did something or failed to do something, within the scope of your employment within certain parameters. The University won't defend you if your actions were the result of fraud, corruption, or malice, or if your defense conflicts with the University's interests. This offer of representation stands even if the University isn't named as a defendant in the lawsuit. However, the University will offer to defend you if the complaint alleges that you did something, or failed to do something, within the scope of your employment as long as your conduct is not the result of fraud, corruption or malice and your defense does not conflict with the University's interests. Representation is not dependent on the University also being named as a defendant in the complaint. If you would like the University to represent you in a case after you have been served, a Request for Representation form needs to be completed.
