California Public Records Act Requests:
The California Public Records Act (Cal. Govt. Code §7922.535) and the McKee Transparency Act (Cal. Education Code §89914(c)) provide that members of the general public may request state agencies and their auxiliary organizations to disclose public records. As a public agency, California State University, San Bernardino (CSUSB) and its auxiliary organizations have a legal obligation to respond within ten (10) days of receipt of the request. The response can, but does not have to, include the actual records. If responsive (non-exempt) records exist, they will be made available for inspection or copying within a reasonable amount of time based on their volume and complexity.
Guidelines for Submissions:
- Must be specific and focused. Where a request is not specific or focused, CSUSB will assist in identifying available records.
- May not interfere with the university's business operations, including any and all university policies. Records that are reasonably required by CSUSB personnel in the performance of their duties may not be available for inspection at certain times.
- Can be oral or in writing. For purposes of clarity, CSUSB encourages written requests.
Certain records are exempt from public disclosure under the California Public Records Act (e.g., Gov. Code § 7927.500 et seq.). CSUSB may redact purely personal and private information from public records. The Public Records Act also does not require CSUSB to create documents that do not already exist.
Upon receipt of a Public Records Act request, CSUSB will conduct a reasonable search for the requested records. The records will be made available for inspection during regular business hours, Monday through Friday, 8:00 a.m. to 5:00 p.m. Records may not be destroyed, altered, or removed from the CSUSB. CSUSB may have university personnel present during an inspection to ensure the records are safeguarded. Hard-copy records can be copied and provided upon payment of a direct duplication cost of $0.20 per page.
